1. About these terms

These Terms of Service apply to your use of dmsnacks.com and purchases made through the DM Snacks online store. In these terms, “DM Snacks,” “we,” “us,” and “our” refer to the business operating this store. Our store is hosted on Shopify, which provides the e-commerce platform we use to offer products and process orders.

Please review these terms before placing an order. Our Shipping Policy, Refund Policy, and, where relevant, Cancellation Policy provide additional purchase information. Our Privacy Policy explains how we handle personal information.

2. Using our store

You must have the legal capacity to enter into a purchase agreement, or use the store with any permission or supervision required by applicable law. You agree to provide accurate contact, billing, payment, and delivery information and to use only payment methods you are authorized to use.

You may not use the store for fraud or other unlawful activity, interfere with its operation, attempt to access another person’s account, or introduce malicious software. If you create an account, keep your login information secure and contact us if you believe it has been used without authorization.

3. Products and product information

We aim to present accurate product descriptions, photographs, prices, sizes, and availability. Images may appear differently depending on your screen, and packaging or presentation may change. The description and options shown for the item you order identify the product being offered.

Please review product information before ordering and check the package’s ingredient, allergen, storage, and preparation information before consuming a food product. If you have a question about an ingredient, assortment, or product detail, contact us before ordering.

Products, assortments, and availability may change for future orders. If a material error or availability issue affects an order you have already placed, we will contact you to explain the issue and available options.

4. Orders and payment

Submitting an order requests the products and quantities selected at checkout. An automated order confirmation acknowledges receipt of your order. If we cannot fulfill an item, identify an error that affects your order, or reasonably suspect an unauthorized transaction, we may contact you for clarification or cancel the affected order or item.

If we cancel an order or item for which payment has been collected, we will refund the amount paid for the canceled portion, including applicable charges that must be refunded under law. We will notify you using the contact information provided with the order.

You authorize the charges disclosed and accepted at checkout. Subscription or other recurring charges apply only when you select and authorize a purchase option that discloses those charges.

5. Prices, taxes, and offers

Prices are shown in the currency identified on the store or at checkout. Shipping charges, taxes, and any applicable discounts are shown during checkout. Please review the order total before submitting payment.

Prices and promotions may change for future purchases. A later price change does not change the price of an order already accepted. Promotional codes, volume discounts, gift cards, and special offers are subject to the conditions disclosed with the particular offer. Do not assume that an offer can be combined with another discount or applied to a corporate order unless its terms say so.

6. Shipping and delivery

Our Shipping Policy explains available shipping services, charges, and destination restrictions. Provide a complete and accurate delivery address and contact us promptly if a correction is needed. We cannot promise that an address can be changed after an order enters fulfillment.

We will ship within the timeframe stated for your order or, if none is stated, within the timeframe required by applicable law. If we cannot meet an applicable shipping deadline, we will notify you and provide any legally required choice to agree to a delay or cancel for a prompt refund. Carrier transit estimates are separate from our shipment obligations.

If a package arrives damaged or does not arrive, email hello@dmsnacks.com so we can review the issue. Nothing in these terms removes rights or remedies you have under applicable law.

7. Returns, damaged orders, and refunds

Our published Refund Policy states that all sales are final and returns are not accepted, including for food products, apparel, and gift cards, except where applicable law requires otherwise.

For a damaged or missing order, contact hello@dmsnacks.com. We will review the issue and any available replacement or refund options. Refunds not otherwise required by law are subject to approval under our Refund Policy. Approved refunds are issued to the original payment method, subject to applicable payment-processing requirements and legally required deadlines.

The final-sale policy does not limit remedies required by law for defective, misdescribed, undelivered, or otherwise nonconforming goods.

8. Changes, cancellations, pre-orders, and subscriptions

Contact us as soon as possible if you need to change or cancel a standard order. Whether we can accommodate a voluntary request depends on its fulfillment status. This does not restrict any cancellation right provided by law.

If a product is offered as a pre-order, subscription, or another special purchase option, review the information shown on that product page and at checkout, together with our Cancellation Policy. Subscription frequency, pricing, and renewal terms must be disclosed when you select that option. You can use the management links in your order emails or contact us for assistance.

9. Corporate and custom orders

Submitting a corporate gifting inquiry requests information or a quote; it does not place an order. Product selections, quantities, pricing, packaging requests, delivery arrangements, and timing are confirmed during the quoting process.

A written quote or separately accepted agreement may include terms specific to that order. Where those accepted terms differ from these general terms, the specific order terms govern the relevant issue, subject to applicable law.

10. Website content and third-party links

Text, photographs, graphics, logos, and other store content are owned by DM Snacks or used with permission. You may browse the site and use information for personal shopping. You may not reproduce or commercially exploit protected content without permission, except as allowed by law.

Our site may link to third-party websites or services. Their content, availability, and terms are controlled by their operators. Review the relevant terms and privacy information before using those services. This does not remove our responsibility for obligations we owe you in connection with your purchase.

11. Privacy and communications

Our Privacy Policy describes how we collect, use, and share personal information. We may use the contact information provided with your order to send order-related messages and respond to your questions.

Marketing subscriptions are separate from order-related communications. Where marketing consent is required, we will request it. You can unsubscribe from marketing messages using the instructions provided in those messages.

12. Store availability and your rights

We may update or maintain the website, and access may occasionally be interrupted. If a technical issue affects an order, contact us for assistance.

Nothing in these terms excludes or limits a warranty, liability, cancellation right, refund right, or other consumer protection that cannot lawfully be excluded or limited. These terms do not require you to waive a legally protected right to make an honest review or pursue an available remedy.

13. Changes to these terms

We may update these terms for future use of the store and future orders. The latest revision date appears above. Changes do not retroactively remove rights or change the agreed terms of an existing order without a valid legal basis or your agreement. We will provide any notice or obtain any consent required by law.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
